Cutler during the day, lo take effect October .1. Gov. Cutler Cut-ler said after the receipt of tho resignation, resig-nation, that he would accept it within the next few days. As to the matter of appointment to fdl the vacancy, Gov. Cutler said that ho had given the matter mat-ter no consideration, as thcro was abundant abun-dant time in which lo reach a conclusion. conclu-sion. Upon the retirement of Justice Barleh tho mantle of Chief Juslico will fall upon Justice W. M. McCarty. The provision pro-vision of tho statute under which Justice Jus-tice McCarty will succeed to the Chief Justiceship is as follows: "The Judge having the shortest term to serve, not holding his office by appointment, or election to fill a vacancy, shall be Chief Justice, and shall preside at all terms of the Supremo court, and, in case of his absence, the Judge having, iu like manner, tho next shortest term, shall preside in his stead." Bagley of Idaho, and A, E. L. Lcclcic of Washington. D. C. The firm name will be Bartch, Bagley & Lcckie. The members of the firm are widely known men, who have attained mucn prominence in their profession. Chief Justice Bartch has been a resident of Utah for many years, during which time ho has served upon tho Probate, District and Supreme benches, with the utmost credit, to himself and tho entire satisfaction of thoso who have appeared as litigants before hi in in his several capacities. ca-pacities. John A. Bagley was at ono time Attorney-General oil Idaho, is a shrewd lawyer, widely known and well liked. A. E. L. The firm will probably occupy a suite of six rooms on the third or fourth floor of ho new Tribune building on South Main street.
